Terms & Conditions
Declaration
‘Buyer’ means the person who buys or agrees to buy the goods from the seller.
‘Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing for the seller.
‘Delivery Date’ means the date specified to which the seller will deliver the goods.
‘Delivery Address’ means the address specified to which the seller will deliver the goods.
‘Goods’ means the articles which the buyer agrees to buy from the seller.
‘Total’ means the price for the goods excluding and VAT if applicable.
‘Seller’ means LLG Wheelchairs Ltd, Parsonagae Garage, kirkhall Lane, Leigh, Lancashire, WN7 5RP
Conditions Applicable
These conditions shall apply to all contracts from the sale of goods by the seller to the buyer to the exclusion of all other terms and conditions.
All orders for goods shall be deemed to be an offer by the buyer to purchase goods pursuant to the conditions.
The price shall be set out on the website. The price is exclusive of VAT which shall be due at the rate pertaining on the date of the seller’s invoice.
In the case of sales financed by way of a loan from a finance company, a deposit will be required at the discretion of the finance company. The goods will be delivered after the credit application has been approved and any satisfaction notes or documentation required by the finance company must be signed.
Warranties and Liabilities
The goods purchased are guaranteed for twelve months from the date of delivery unless stated, parts replaced under this guarantee will be covered for the balance of the warranty period.
Exclusions – in the case of mobility vehicles / wheelchairs the guarantee does not cover tyres, inner tubes, punctures, belts, bulbs, upholstery, motor brushes, fuses or batteries or any other item that may need replacing due to normal wear and tear.
Batteries are specifically covered by a limited manufacturer guarantee subject to stringent wear and tear clauses.
Any claim under this guarantee will only be settled if tests confirm that the fault occurred directly because of a defect in material used in manufacture.
Delivery
The delivery date is approximate and the seller shall not be liable for any delay of the goods beyond his reasonable control. Time delay shall not be of the essence of this contract.
Storage and Access
LLG Wheelchairs Ltd cannot accept responsibility for access to the property by provision of ramps and storage of scooters is the buyers responsibility ( unless such ramps are purchased from LLG Wheelchairs Ltd). In ordering such a machine it is implied that the buyer will provide storage and means of access that they deem suitable.
Variation to Design/Specification and Acceptance of Goods
The seller reserves the right to vary or alter the description/Specification of the goods ordered without notice at any time prior to delivery provided that such variation or alteration does not materially affect their quality or performance.
The buyer shall inspect the goods and give notice of any defect on inspection when signing for the delivery before use.
Passing of Property
Title shall pass on delivery of goods and upon receipt of full payment.
Bathroom & Toilet Aids
Due to health and safety and hygiene regulations please note these items are non refundable.
Cancellation Rights
The seller acknowledges the personal nature of the goods. The buyer may cancel this order provided notice in writing is received by the seller within fourteen days of the order being placed and provided the goods have not been manufacture. In such event but not further or otherwise the seller will refund to the buyer all monies paid under the contract.
